1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and ArbiGet ("Company," "we," "us," or "our") governing your access to and use of the ArbiGet platform, including our website, applications, APIs, and all related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
2. Description of Service
ArbiGet is a prediction market arbitrage detection platform that:
- Aggregates publicly available market data from prediction market platforms including Kalshi, Polymarket, and other supported exchanges
- Identifies potential arbitrage opportunities across different markets
- Provides real-time alerts and notifications about detected opportunities
- Offers analytical tools and historical data for market analysis
ArbiGet does not execute trades on your behalf, manage your funds, or provide access to prediction market platforms. You are responsible for maintaining your own accounts on the underlying prediction market platforms.
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using the Service under applicable laws
- Comply with all laws and regulations applicable to prediction markets in your jurisdiction
4. Account Registration
To access certain features of the Service, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your login credentials secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach
5. User Responsibilities
When using the Service, you agree to:
- Use the Service only for lawful purposes
- Conduct your own research and due diligence before making any trading decisions
- Comply with all applicable laws, regulations, and the terms of service of underlying prediction market platforms
- Not attempt to circumvent any security features or access restrictions
- Not use automated systems (bots, scrapers) to access the Service in a manner that exceeds reasonable use
- Not redistribute, resell, or commercially exploit the Service without authorization
- Not engage in market manipulation or fraudulent activities
6. Subscription and Payments
6.1 Subscription Plans
ArbiGet offers various subscription plans with different features and pricing. Details of each plan are available on our pricing page. We reserve the right to modify subscription offerings at any time.
6.2 Billing
Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method for all applicable fees.
6.3 Cancellation and Refunds
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. We offer a 30-day money-back guarantee for new subscriptions. After 30 days, refunds are provided at our sole discretion.
7. Intellectual Property
All content, features, and functionality of the Service, including but not limited to text, graphics, logos, algorithms, and software, are owned by ArbiGet and are protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.
8. Third-Party Data and Platforms
The Service aggregates data from third-party prediction market platforms including Kalshi, Polymarket, and others. We do not control these platforms and are not responsible for:
- The accuracy, completeness, or timeliness of data from these platforms
- Changes to their terms of service, availability, or pricing
- Actions taken by these platforms that may affect your trading activities
- Any disputes between you and these platforms
9. Risk Disclosure
Trading in prediction markets involves substantial risk of loss and is not suitable for all individuals. You should carefully consider whether trading is appropriate for you in light of your financial condition.
Key risks associated with prediction market arbitrage include:
- Execution Risk: Prices may change between when an opportunity is identified and when you attempt to execute trades
- Liquidity Risk: Markets may not have sufficient liquidity to execute trades at displayed prices
- Platform Risk: Technical issues or changes on underlying platforms may prevent trade execution
- Regulatory Risk: Changes in laws or regulations may affect your ability to trade
- Counterparty Risk: Underlying platforms may become insolvent or unable to honor obligations
- Data Accuracy Risk: Information displayed may be delayed, inaccurate, or incomplete
Past performance of arbitrage opportunities does not guarantee future results. Never trade with money you cannot afford to lose.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION
- WARRANTIES THAT ARBITRAGE OPPORTUNITIES WILL BE PROFITABLE OR SUCCESSFULLY EXECUTABLE
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARBIGET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, data, or business opportunities
- Any trading losses or missed opportunities
- Any damages resulting from unauthorized access to your account
- Any damages arising from third-party platforms or data sources
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless ArbiGet and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:
- Your right to use the Service will immediately cease
- We may delete your account and associated data
- Any outstanding payments will become immediately due
- Provisions that by their nature should survive termination will remain in effect
14. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the modified Terms.
15. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and held in Delaware.
16. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and ArbiGet regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
- Waiver: Our failure to enforce any right or provision shall not constitute a waiver.
- Assignment: You may not assign these Terms without our prior written consent.
